Intellectual Property Policy – HockeyAloha

At HockeyAloha, we operate an online platform that empowers users to create and sell custom T-shirts and other merchandise. We strictly prohibit the use of our platform to design, upload, or sell items that infringe on the intellectual property rights of others—including copyrights, trademarks, and other protected works. If you believe that your intellectual property has been misused on HockeyAloha, please follow the procedure outlined below to report the infringement.

A. How to Report Intellectual Property Infringement

In accordance with our policy, HockeyAloha will:

  1. Remove or disable access to any content (including but not limited to text, images, or graphics) that, in good faith, appears to violate the intellectual property rights of third parties upon receipt of a valid notice; and

  2. Terminate access to the platform for users who repeatedly infringe on such rights.

If you believe your intellectual property has been infringed upon via the HockeyAloha platform, please submit a written notice containing the following information to our designated agent:

  1. Identification of the work: Specify the copyrighted work or other intellectual property you claim has been infringed, including registration numbers if applicable.

  2. Identification of the infringing content: Describe the content you believe to be infringing, how it infringes on your rights, and where it is located on HockeyAloha—with enough detail for us to locate it.

  3. Your contact information: Provide your full name, mailing address, telephone number, and email.

  4. Good faith declaration: A statement affirming that you believe the use of the content in question has not been authorized by you, your agent, or the law.

  5. Accuracy and authority statement: Under penalty of perjury, declare that the information you’ve provided is true and that you are the rightful owner or authorized to act on behalf of the owner.

  6. Signature: Include a physical or electronic signature of the person authorized to act on behalf of the rights holder.

B. What Happens After We Receive a Valid Notice

Upon receipt of a properly completed infringement notice:

  1. We will remove or restrict access to the allegedly infringing content.

  2. We will notify the user who posted the content.

  3. In cases of repeat infringement, HockeyAloha reserves the right to terminate the user’s account and access to our platform.

C. How to Submit a Counter-Notice

If you are the user whose content was removed or disabled and you believe this was a mistake or misidentification, you may submit a counter-notice. Your counter-notice must include:

  1. Description of the content: Identify the material removed or disabled, and where it was located on the HockeyAloha platform before removal.

  2. Good faith belief: A statement, under penalty of perjury, that you believe the content was wrongly removed or disabled.

  3. Your contact information: Full name, mailing address, telephone number, and email.

  4. Jurisdiction consent: A statement that you consent to the jurisdiction of the Federal District Court for your location—or, if outside the U.S., the jurisdiction where HockeyAloha is based—and that you will accept service of process from the original complainant.

  5. Your signature: A physical or electronic signature.

Once we receive a valid counter-notice, we may send a copy to the original complaining party. Unless the rights holder initiates a lawsuit within 10 business days, HockeyAloha may reinstate the content or restore access within 10 to 14 business days—or later, at our discretion.

Important Notice

Please be aware: under Section 512(f) of the Digital Millennium Copyright Act (DMCA), anyone who knowingly submits a false claim regarding infringing content may be held liable for damages, including attorney’s fees.
